Terms and conditions - Farbound Travels

Terms & Conditions

These Terms and Conditions apply to all trips and travel services arranged for or provided to you (“you,” which term shall be deemed to refer to you and any person in your party) by Farbound Travels (“we” or “us”). Please read them carefully. These Terms and Conditions, along with the Invoice(s) and the Itinerary (collectively, the “Documents”), constitute the contractual relationship between you and us, which begins when we receive your deposit (or any payment from you).

Reservations and payments

Reservations will be confirmed, based on availability, upon written notice from us to you of the number of travelers in your party and upon your payment of a deposit to us. We will share a payment link for your convenience, which can be used to pay the deposit by major credit card. Alternatively, you may send a cheque made out to “Farbound Travels.” The balance payment is due as outlined in the Invoice(s), and a payment link will be provided for this as well.

cancellations and refund policy

Farbound Travels strives to provide our clients with the best travel experiences. However, we understand that plans may sometimes change. Below is our cancellation and refund policy:

  • 85% Refund: For cancellations made 3 months or more before the departure date.
  • 50% Refund: For cancellations made between 1 to 3 months before the departure date.
  • No Refund: For cancellations made less than 30 days before the departure date.

Refunds will be processed and reflected in your account within 14 working days from the date of confirmation.

Important Notes
  • Refunds are subject to the specific refund policies of hotels, airlines, operators, and other vendors involved in your trip. Some vendors may have strict cancellation policies with substantial penalties where funds paid are non-refundable. As a result, the amount refunded to you may be further reduced.
  • Changes made to the itinerary after departure must be paid to Farbound Travels and are non-refundable.
  • Comprehensive travel insurance is required, covering trip cancellation, medical evacuation, and lost belongings. If you choose not to purchase travel insurance, you must sign a waiver acknowledging the risks and your acceptance of this cancellation policy.
  • Any payment made to Farbound Travels constitutes acceptance of our Client Agreement.
  • Any adjustment to government-imposed taxes will be borne by the client.
  • Currency exchange rates are calculated on the original invoice date and will not be adjusted due to fluctuations.

Cancellations by Us

If we cancel the trip prior to departure, you will receive a full refund of amounts paid to us. Please note that costs for visas, commercial air tickets, and pre- or post-tour independent arrangements may not be refundable. If, as a result of circumstances beyond our control, we must change or cancel the trip after departure, we will not reimburse you for expenses incurred. If, in our reasonable opinion or that of any airline pilot, hotel manager, tour leader, or other person in authority, your behavior is causing danger or damage to property, we reserve the right to terminate the trip without any refund.

Itinerary Changes
  • Changes by You: We will make every effort to assist you if you wish to make changes to the itinerary after departure, but it may not be possible. You must pay us the cost of any such changes, and these costs and payments are non-refundable.
  • Changes by Us: We will make every reasonable effort to maintain the itinerary as planned; however, accommodations, transportation, and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond our control, including transportation cancellations, delays, hotel issues/problems, and other schedule changes. We are not responsible for such unanticipated and uncontrollable changes, and any expenses resulting from such changes (e.g., additional hotel, transportation, or guide fees) will be paid by you. You may be eligible to recoup such costs from your travel insurance carrier. We reserve the right to modify or change the itinerary in the best interests and safety of the group, at our sole discretion. We also reserve the right to withdraw a program or any part of it, to make such alterations to the itinerary or program inclusions as we deem necessary or desirable, and to pass on to you any expenditures or losses caused by delays or events beyond our control. The operations of all flights are subject to foreign governments’ approval. In the event that a landing or flyover right cannot be obtained by the air carrier, alternative arrangements will be made at our discretion.
Travel Documents

Entry visas may be required for the countries listed on the Itinerary. Acquiring required visas and entry permits in advance of the trip is your responsibility unless otherwise specified in the Invoice(s) or the Itinerary. Failure to obtain visas or entry permits does not negate these Terms and Conditions. You are responsible for any costs incurred (e.g., for rerouting) because you do not have the required visas or entry permits. We cannot provide a refund if you are unable to proceed with the trip because of incorrect or missing personal documents, or any other failure to meet passport, visa or immigration requirements. Please note that passports must be valid for six months after the return of the trip and should also have sufficient blank pages for visas and immigration stamps. You must have a government-issued photo ID prior to your initial departure.

Flight Guidelines

During your flight, you must:

  • Comply with all applicable laws and crew instructions regarding safety, security, and passenger comfort, including seating, seat belts, smoking, alcohol consumption, and electronic device use.
  • Only consume alcohol served by the air carrier and refrain from smoking or tampering with smoke detectors on board.
  • Be ready for boarding on time and comply with all flight permits and licenses.

The air carrier reserves the right to:

  • Screen you and your baggage for security purposes. We and the air carrier are not liable for any issues arising from security screening.
  • Inspect your baggage and refuse to carry items considered dangerous or unsuitable for air travel, including hazardous materials or weapons.
  • Require you to declare any dangerous or prohibited goods before the flight. Without written permission, such items are not allowed on board.

If you fail to comply with these guidelines:

  • We or the air carrier may report you to authorities and take necessary actions, including physical restraint or removal from the aircraft.
  • The air carrier may refuse to carry you in the future.
  • You will be responsible for covering any costs incurred due to your actions, including repairs, compensation, or flight diversion, as well as any applicable cancellation charges
Assumption of Risk

By booking with Farbound Travels, you acknowledge that your trip involves travel to remote and potentially risky areas. You agree to take full responsibility for your safety and well-being, including unforeseen events such as injury, illness, theft, emotional trauma, death, natural disasters, war, terrorism, force majeure, weather-related issues, civil unrest, government actions, or any occurrences beyond our control, including itinerary changes and transportation that may not meet North American standards.

You accept all risks related to altitude, illness, physical injury, disease, alcohol consumption, and physical activities, understanding that access to evacuation and adequate medical care may be limited. You are fully responsible for any injury, loss, or damage you may experience or cause, including the safety of your personal belongings.

Travel Insurance

You are responsible for purchasing comprehensive travel insurance, including coverage for trip cancellation, health, accidents, and medical evacuation. We can recommend international travel insurers if needed. We strongly advise securing insurance that covers personal injury, death, liability, property damage, accidents, trip delays, cancellations, medical emergencies, evacuation, lost belongings, missed departures, legal expenses, and any inconveniences arising from:

  1. Any wrongful, negligent, or unauthorized acts or omissions by service providers, such as airlines, hotels, and restaurants, or their employees and agents.
  2. Defects or failures in vehicles, equipment, or aircraft owned by service providers.
  3. Wrongful, negligent, or unauthorized acts or omissions by third parties.

Please keep your insurance details with you during the trip.

Limitation of Liability

Farbound Travels and its affiliates (the “Released Parties”) do not own or operate any service or goods providers involved in your trip. We work with independent suppliers for transportation, accommodation, dining, ground handling, and other services. These suppliers operate as independent contractors.

Each supplier has its own booking conditions or conditions of carriage, which are binding between you and the supplier. Some of these conditions may limit or exclude the supplier’s liability to you. You can request copies of these conditions from us or directly from the supplier.

You waive any claims or actions against the Released Parties for any loss, damage, injury, or death, including any claims for consequential, indirect, special, incidental, punitive, or exemplary damages. This release is legally binding upon you, your heirs, successors, assigns, and legal representatives, reflecting your full assumption of travel risks and releasing the Released Parties from all liabilities to the maximum extent permitted by law.

The Released Parties are not liable for any negligent or intentional acts committed by service providers or third parties. We are not responsible for damage, loss of property, injury, or death caused directly or indirectly by any act or omission of any service provider or third party, including defects in aircraft, watercraft, or vehicles provided by them. Your recovery for any claim related to the trip is limited to the amount you paid us for services, regardless of the claim’s nature (contract, tort, warranty, etc.). These limitations do not apply to damages that cannot be legally disclaimed.

The passenger tickets issued by carriers serve as the sole contract between the carrier and the passenger; carriers are not responsible for any act, omission, or event during the trip.

Non-Waiver

Our failure to enforce any provision of the Documents at any time does not limit our right to enforce that provision in the future. Any waiver of a breach does not constitute a waiver of our right to enforce that provision or any other provision.

Severability

If any provision of the Documents is deemed invalid, it will be modified to the extent necessary to be enforceable, without affecting the validity of the remaining provisions.
